1. Definitions

In these Terms of Service (the Terms):

  • InHarness, we, us and our mean the operator of the website available at https://www.inharness.co.uk.
  • Site means the website located at https://www.inharness.co.uk, including all pages, content, features and services provided through it.
  • User, you and your mean any person who accesses or uses the Site, whether registered or not.
  • Content means any text, images, graphics, audio, video, software, data compilations, articles, posts, comments, reviews or other materials displayed on, made available through, or submitted to the Site.
  • Services means any functionality, tools, subscriptions, communications, features or other services made available on or through the Site.
  • Terms means these Terms of Service, as updated from time to time.
  • Third-Party Services means any websites, platforms, applications, tools, products or services provided by parties other than InHarness that may be referenced, embedded, integrated or linked on the Site.

By accessing or using the Site, you acknowledge that you have read, understood and agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use the Site.

If you use the Site on behalf of a business or other organisation, you represent that you have authority to bind that entity, and your acceptance of the Terms will be treated as acceptance by that entity.

3. Eligibility and Account Management

The Site is intended for Users who are at least 16 years of age. If you are under 16, you must not use any interactive features of the Site. If you are under 18, you may use the Site only with the consent and supervision of a parent or guardian.

Where the Site allows or requires account registration, you must provide accurate, current and complete information, keep your credentials confidential and secure, and promptly update any changes. You are responsible for all activities that occur under your account.

You may view and print Content for your personal, non-commercial use only, provided you do not remove or alter any copyright or other proprietary notices.

If the Site allows you to submit or upload Content (User Content), you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to use, host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display your User Content in connection with the Site and our business, in any media now known or later developed. You represent and warrant that you own or have all rights necessary to grant this licence and that your User Content does not infringe any third-party rights or violate any law.

If you are a consumer, nothing in these Terms affects your statutory rights.

You agree to indemnify, defend and hold harmless InHarness and our officers, employees, agents and contractors from and against all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your violation of any law or third-party rights; or (c) your User Content.

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. InHarness is the data controller for personal data processed in connection with the Site.

The courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims). If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your local courts.
